Terms and Conditions of Sale Walko Guitars

ARTICLE 1 – SCOPE AND MODIFICATION OF THE TERMS AND CONDITIONS OF SALE

These terms and conditions of sale apply to any order placed on the website https://www.walkoguitars.com, owned by Mr. Nicolas Walkowiak. The company (registered at the Toulouse registry) is registered with the Trade and Companies Register under SIRET number 79028378200031.

Walko Guitars reserves the right to adapt or modify these terms and conditions of sale at any time. In case of modification, the terms and conditions in force on the day the order is placed shall apply to each order.

ARTICLE 2 – PRODUCT AVAILABILITY

Upon receipt of your order, we check the availability of the product(s) ordered. In case of unavailability, we undertake within 30 days from the date of the order either to deliver the ordered product, offer a similar product at a similar price, or refund you.

ARTICLE 3 – PRICES

Prices are expressed in euros and do not include shipping costs. The user must pay these shipping costs unless a special offer exempts them. Walko Guitars reserves the right to modify its prices at any time, notably in the event of increased costs or an obvious error, but commits to applying the prices indicated to you at the time of your order, subject to availability on that date.

It should be noted that under Article 293 B of the French General Tax Code, products sold on the WalkoGuitars website are not subject to VAT.

ARTICLE 4 – PAYMENT METHODS AND SECURITY

Payment methods:
You can make payment:

  • By Credit Card: No banking information is transmitted via the Walko Guitars website. Payment by credit card is fully secured via Stripe and Woo Payment; your order will be recorded and validated upon acceptance of payment by our banking service.

  • By PayPal: A PayPal account is required to pay via this method. Fees may be charged by PayPal, which will be the responsibility of the buyer. http://www.paypal.com/fr/

Retention of Title Clause:
Products remain the property of Walko Guitars until full payment of the order. However, from the moment of delivery, the risks of the delivered goods are transferred to the customer.

Non-payment:
Walko Guitars reserves the right to refuse delivery or fulfillment of an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is pending.

Anti-fraud checks:
As part of these procedures, our services may request all necessary documents to unblock your order: proof of address and bank card in your name, etc. These requests will be made by email.

ARTICLE 5 – DELIVERY TERMS

Walko Guitars cannot be held responsible for consequences caused by a delivery delay by the carrier. Walko Guitars may be exempt from any liability by proving that non-performance or improper performance of the contract is attributable either to the consumer or to an unforeseeable and insurmountable act of a third party to the contract.

General:
Products purchased on the Walko Guitars website can be delivered to any country.

For countries outside the European Union, additional fees may apply. It is the buyer’s responsibility to be aware of any fees that may apply in their country. Walko Guitars cannot be held responsible for international shipping fees.

For tracking purposes, delivery to military bases, hospitals, or vacation centers is not possible.

Delivery methods:
The ordered product is shipped via Chronopost, depending on the nature of the product and to the address provided in the order form.

From package to delivery:
You must check the conformity of the delivered goods at the time of delivery and before signing the delivery slip. Any anomaly (damaged product, etc.) must be noted in writing on the delivery slip with your signature.

You must also confirm these reservations by registered mail to the carrier within three working days of receipt and send a copy to “Walko Guitars, attn. Mr. Nicolas Walkowiak, 10 Impasse de Saubens, 31860 Pins Justaret.” If products need to be returned, they must be returned within fourteen working days of delivery, according to distance selling legislation (excluding international delivery, for which please contact us before ordering for a quote). Claims outside this period will not be accepted. Returns will only be accepted for products in their original condition without wear (packaging, flight case, straplocks, accessories, certificate, etc.).

If the original packaging is damaged, torn, or opened at the time of delivery, you must check the condition of the items. If damaged, you must refuse the package and note the issue on the delivery slip. Refused packages will be returned directly to us.

ARTICLE 6 – LIABILITY

Walko Guitars cannot be held responsible for non-performance due to force majeure, accidents, disruptions or strikes (including postal services and transportation), floods, fires, or other unforeseen events.

The choice and purchase of a product are the sole responsibility of the customer. Total or partial inability to use the products, including incompatibility, does not give rise to compensation, refund, or liability of Walko Guitars.

In case of non-delivery of an order or part of an order, you have 60 days from the order date to contact us. After this period, no claims will be accepted.

Instruments containing protected woods (e.g., Brazilian Rosewood) are provided with official CITES certificates ensuring traceability and origin.

ARTICLE 7 – RIGHT OF WITHDRAWAL

Withdrawal period:
In accordance with Articles L121-21 to L121-21-8 of the French Consumer Code, the consumer has a period of fourteen days to exercise their right of withdrawal without giving reasons or paying penalties, except for potential return shipping costs. This period begins from receipt of the goods or acceptance of the offer for services.

Products must be in their original condition without wear (packaging, flight case, straplocks, accessories, certificate, etc.). The right of return does not apply to consumables that have been used (e.g., guitar strings) unless returned within the deadline and in original packaging.

Return procedure:
Return shipping costs for withdrawal are the customer’s responsibility.

The right of return only applies to complete products in their original condition (packaging, accessories, instructions) with a copy of the purchase invoice. Incomplete, damaged, or soiled items will not be accepted or exchanged.

We commit to exchange, credit, or refund within 15 days of receipt of the products.

Any instrument modified by the buyer in any way cannot be returned. Any modification cancels the right of withdrawal.

To get the best from your instrument, Walko Guitars equips guitars with strings suited to your needs (gauge on buyer’s request). In case of return, the customer cannot claim a refund for strings replaced on their own initiative.

Custom range instruments:
Any purchase of a Walko Custom instrument is final. Due to the specific nature of instruments made to the buyer’s request, no returns are accepted (except in case of manufacturing defect).

For Walko Edition guitars modified at the buyer’s request (Floyd Rose installation, special color, or any modification giving the instrument a unique character), the right of return does not apply.

No cash-on-delivery shipments will be accepted.

Special terms for Walko Custom and personalized models:
Due to the unique nature of Walko Custom instruments (guitars & basses), returns are not accepted. Upon confirmation of the quote by Mr. Nicolas Walkowiak, it is agreed that the buyer cannot withdraw or return the custom-made instrument.

The same applies to Walko Edition models with buyer-requested modifications that give a unique or highly specific character.
